Lithium ion battery can be dangerousOur personal injury law firm is concerned about the recent news regarding lithium-ion batteries causing deadly fires in New York City. According to reports, a 64-year-old man died in a Bronx apartment fire caused by a defective lithium-ion battery over the weekend, and the FDNY has reported 33 fires caused by these batteries this year, resulting in three deaths and 42 injuries.

To address this issue, Mayor Eric Adams signed  five bills into law aimed at preventing fires caused by lithium-ion batteries in New York City (see our previous blog about these bills related to e-bike battery safety). 

While the bills only address lithium battery safety in New York City, there is a need for federal legislation to ensure that batteries are safely manufactured and used. Currently, compliance with safety standards is voluntary, and the wide availability of uncertified or after-market tampered batteries is contributing to the problem. Additionally, a change in federal law in 2016 exempts imports below $800 from inspection and tariffs, which has made it easier for uncertified or unsafe batteries to enter the market.

lithium-battery-can-be-deadly-2An e-bike battery explosion caused a deadly fire in Harlem, NYC, inside NYCHA’s Jackie Robinson Houses.

5 year old Erika Williams was sleeping in a an apartment with her dad Erik Williams and his 36 year old girlfriend Chanise Anderson when a little after 2:30 am on Wednesday morning, the lithium battery of an e-bike stored next to the apartment entrance door exploded and created a fire.

The fire and heavy smoke prevented the toddler and the girlfriend to escape while the father covered in flames ran into the hallway screaming for help. He is still in the hospital in critical condition. The 5 year old girl and the girlfriend both died. 3 dogs also died in the fire.

A defective moped lithium battery is at the origin of a fire that killed 9 year old Remi Fernandez in his new apartment in Queens. Remi had just moved with his parents into a new apartment located on 102nd Road near 84th Street in  Ozone Park, Queens, when a fire that was sparked by the battery of a moped charging in the apartment erupted around 2:00 am while the family was sleeping. Remi’s father suffered burn injuries as he was trying to rescue his little boy from their basement apartment. The apartment where the family had just moved in had no smoke alarm. The basement had been illegally converted into an apartment.  The rest of the building was deemed unsafe by the Department of Buildings and all residents had to be evacuated. 10 other people including a firefighter were injured and transported to the hospital to be treated.

55 fires caused by defective lithium ion batteries over the last 12 months in New York City

Fire caused by defective lithium-ion batteries are on the rise in New York City. According to the NY Daily News, there were 55 fires caused by these types of batteries in New York City between August 1st 2020 and August 1st 2021 compared to 22 for the same period a year earlier.  Sadly Remi is not the first victim to die in one of these fires. Last May in the Bronx, a 91 year old woman died and 11 people were injured in a fire sparked by a defective lithium battery in the third floor apartment of a six-story building in the Bronx. Earlier in January, a   scooter charging in the living room of a Bronx apartment was at the origin of another fire that killed one and injured 12 others.

E-Cigarette-1E-Cigarettes are dangerous products that can lead to serious personal injury.  The New York Health Department is investigating 11 cases of teens and young adults who suffered severe lung illnesses after vaping. Their cases are among the 94 cases reported nationally to the Center for Disease Control. The CDC announced a few days ago that investigation in these cases were ongoing.

In New York, parents and kids will be protesting teen vaping Today in front of the JUUL offices in Manhattan.  Among the cases reported to the CDC, an 18 year old teenager said that he checked in at the emergency room after he had been using JUUL e-cigarette for a year and half. He felt like he was having a heart attack. Doctors found his lungs had collapsed and he had to go for immediate surgery. The doctors said that the inflammation in his lungs could have come from something he inhaled.

Vaping is extremely popular among young adults especially with high school and middle school students

Hoverboard fireAnother defective hoverboard burst into flames creating a fire in a New York City home last week. According to the FDNY this is the third recent case of  a hoverboard fire in the city. Lorraine White from Staten Island paid more than $400 for a Swagway hoverboard for her son last Christmas. She knew about the risk of fire. Therefore she avoided buying a cheap knockoff and paid over $400 for a popular “Swagway” model thinking that it would be safer. It wasn’t the case.  One evening, the hoverboard started to smoke in her son’s room and then burst into flames destroying part of the bedroom. Thankfully nobody was injured. Another boy from Staten Island suffered personal injury after he tried to clean his hoverboard during a vacation in the Poconos. 11 year old Brandon Miller was hospitalized after the middle finger of his left hand became stuck between the wheel and the base. According to the mother the device started rotating unexpectedly and sucked the boy’s finger in. The boy may risk loosing his finger due to infection and may have permanent burn scares.

Previoulsy the FDNY was also called to stop a fire caused by a defective product in Brooklyn.  (see NY Daily News)
