Report a potholeA New York bicyclist suffered severe personal injury after he hit a pothole and impaled his neck on a nearby fence. The man in his forties was riding his bike near Stockholm Street and Woodward Ave in Ridgewood, Queens, NYC, when the bicycle accident happened. The man hit the pothole and fell off the bike, hitting his head on the ground. He then tried to stand up but stumbled on a metallic fence on which he impaled his neck. The fence went all the way through his neck. When the EMS arrived they had to cut part of the fence to be able to treat the bicyclist. He was taken to the hospital in stable condition.

Several cyclists interviewed by the NY Daily News were aware of the pothole and said the bicycle accident could have been avoided if the city was more proactive in repairing the potholes.  We can only hope that these cyclists were proactive as well and had previously taken a picture of the pothole and reported it to the City so that this bicyclist stands a chance to be compensated by the City for his gruesome injuries.  In New York, most pothole cases can only be won if the City had “written notice of the defect” before the accident occurred. If you are a bicyclist or a pedestrian in New York City and you notice a pothole, snap a pic and report it! It doesn’t take long and it may cause repair and protect a bicyclist in the future.

In New York State, the Department of Motor Vehicles does’t remove driving privileges based on age but an elderly driver may be requested to pass a re-evaluation program. New York State Vehicle & Traffic Law Section 506 (1) states that: “If the Commissioner has “reasonable grounds” to believe that a person holding a license is not qualified to drive a motor vehicle, the Commissioner may require such person to submit to an examination to determine their qualifications.”

If you have an elderly parent or close relative who you feel no longer has the ability to drive safely it is incumbent on you to discuss with them your concerns. This is a very difficult discussion to have since giving up one’s driving privileges makes one feel a loss of independence. Such a discussion must be in a reasoned manner. For an excellent article on having this discussion see “How to Talk to Elderly Adults About Giving up the Keys” by Constance (Connie) Matthiessen in caring.com.

A motorist who was speeding lost control of his car and crashed into a SUV , spun around ran into other parked cars, injuring himself and 3 other people including a a woman who was four months pregnant. What will it take to prevent these needless accidents caused by drivers who are so irresponsible they never consider the dire consequence of their behavior. Long term suspension of their licences would be a good start. When death or catastrophic injuries result jail would not be a bad idea. Too few accidents caused by reckless driving result in criminal prosecutions. See our post above.  The car accident happened last Friday around 7:00 pm on Boston Road near East Gunhill Road in the Bronx, NYC. Read more in the NY Daily News

Right of WayLowering the speed limit from 30 mph to 25 mph on Prospect Park West may have saved the life of 5 year old Roark Bennett who was hit by a car at the exact same spot where 12-year-old Sammy Cohen Eckstein was fatally struck by a car two years earlier.  After the death of her son, Amy Cohen became a Vision Zero activist and successfully campaigned to lower the speed limit on Prospect Park West from 30 mph to 25 mph.  Yesterday when Roark Bennett escaped from his parents and ran out in the street against the light, the driver who hit him was travelling at the speed limit and thankfully Roark suffered only minor injuries.  Read more in the NY Daily News
