New York personal injury attorney Stuart Schlesinger won $875,000 in a medical malpractice lawsuit for a client but the client never saw the money. Margaret Last, a a former executive assistant turned to attorney Stuart Schlesinger after a treatment from a podiatrist left her in so much pain that she had to start using a wheelchair or a cane to get around. She was relieved after Stuart Schlesinger was able to win $875,000 in a medical malpractice lawsuit against the podiatrist. However a year after, Margaret Last still hasn’t received any of her money according to a lawsuit that she filed against Schlesinger.

It is not the first time that Schlesinger has committed legal malpractice. He was arrested in December for defrauding clients of over $3 Million dollars in settlement proceeds.

The conduct of this NYC personal injury attorney is a disgrace to our entire profession. This is exactly what a lawyer should not be. Most of the lawyers who practice in the personal injury field, as we do, put their clients interest first and work to serve their needs. The fact that a lawyer could steal a seriously injured person’s money is unacceptable. The harshest possible sentence should be handed down against Stuart Schlesinger because he broke the most basic bond of trust between lawyer and client.

Nupur BatenA man who was backing out of his driveway in Brooklyn, NYC, fatally struck his wife as she was trying to guide him.  Sakwat Hossain who just got his New York City driving license 3 months ago lost control of his vehicle as he was backing out of the family house driveway on E. 32nd Street near Avenue D in Flatbush, Brooklyn. He hit his 26 year old wife, Nupur Baten who got pinned against the wall of the adjacent appartment building. She was rushed to the hospital but she didn’t survive. She leaves a 4 year old and a 10 month old behind. Read More in the NY Daily News

Our New York Personal Injury Lawyers represented a woman who was also accidentally run over by her husband. He was backing up to pick her up and did not realize she was standing in the street. She suffered serious spinal injuries. Fortunately the husband had purchased an endorsement in his insurance policy specifically stating that interspousal liability was covered by the policy. In New York if this is not explicitly included in the policy interspousal accidents will not be covered. Too many people do not understand this and do not purchase the endorsement.

To the extent that the medical record contains false or inaccurate information, it is not enough for the trial lawyer prosecuting a medical malpractice case to expose a limited error. The goal should be to attack in such a way as to show that the entire record is untrustworthy.

The following video is a demonstration of an opening statement in a wrongful death case.  The plaintiff was represented at trial by our managing  partner New York Personal Injury Lawyer Ben Rubinowitz. The case involved the death of a little girl who was a passenger in a car being driven by her father. She was killed as a result of the combined negligence of a truck driver and the carelessness of the City of New York. The case was significant in that the little girl’s father was in the”zone of danger” when he witnessed the death of his daughter. The jury returned a substantial multi-million dollar verdict in the case finding both the truck driver and the City at fault.

New York Personal Injury lawyer Anthony GairA bill that makes it a felony for drivers to kill or injure others while driving without a license was passed yesterday by the New York State Senate. The bill was introduced by state Senator Michael Gianaris (D-Astoria) following the death of Noshat Nahian, an 8 year old pedestrian who was on his way to school when he was fatally struck  by a tractor-trailer driven by an unlicensed driver. Our partner, personal injury lawyer Anthony Gair (picture) who is in charge of the case commented: “This is a very important bill and long over due. In this tragic case, all charges against the driver were dismissed except for driving without a licence for which he paid an $85 fine. This is outrageous in a case in which Noshat was in the crosswalk with the right of way and easily visible at the time the tractor trailer turned left striking him. Hopefully the law will also discourage commercial carriers from hiring unlicensed truck drivers.” Read more in the Times Ledger

brNew York Personal Injury Lawyer Ben Rubinowitz who is representing Dana Lerner and Richard Stock in a wrongful death lawsuit against Koffi Komlani, the taxi driver who killed their son Cooper in a traffic accident, said to the New York Post that both parties were proprely served after the lawyers representing the cabbie tried to  use a technicality to dodge the lawsuit.

Copper was crossing the road with his dad at 97th Street and West End Avenue in the Upper West Side in January 2014 when he was fatally struck by the taxi driver who was making a left-hand turn. A witness took a video of Richard Stock trying to pick up his son just after he was run over by the taxi. This video will be included in the lawsuit. “[Richard Stock] is screaming at the top of his lungs. There could never be anything worse for a father,” said Ben Rubinowitz.

Because of insurance caps, Cooper parents do no expect to receive more than $50,000 but they want to pursue a wrongful death lawsuit to hold the cab driver accountable for his recklessness.
