Ghost bike showing locations of previous NYC deadly bicycle accidentsA cruel and reckless driver  blows a stop sign, hits a cyclist critically injuring him, drives away, comes back, takes a look at the cyclist, gets back in his car and speeds away.

The accident occurred at night last week in the Bronx. A 46 year-old cyclist was riding his bike through the intersection of Dudley and Edison Avenues in Pelham Bay when a driver blew the stop sign and slammed into him.  A video surveillance first shows the driver taking off.  He then returned to the scene of the accident, took a look at the victim who was suffering critical injury and took off again. The victim was found by EMS and rushed to the hospital. (Read more in the Daily News)

Bicycle accidents injuries in the Bronx have been on the rise during this period of the year compared to the same period last year.  According to the most recent NYPD traffic statistics, 17 people were injured in bicycle accidents in the Bronx during the week of April 5 to April 11 compared to 2 during the same week a year earlier.  Last years numbers were much lower because the city was observing the Covid19 lock-down and the streets were mostly empty. The same can be said when looking at statistics on a 4 week basis. 54 people were injured in Bronx bicycle accidents between March 14 and April 11 2021 compared to 20 for the same period a year earlier.

location of the gas explosion accidentA  gas explosion injured 10 people including several children in the Bronx, NYC.

The explosion blasted a three story multi-family residence located at 1520 Paulding Avenue in Morris Park, yesterday afternoon around 3:30 pm.  A gas leak on the building’s second floor  seemed to have been at the origin of the explosion according to preliminary investigations.

A tenant who  was watching television on the first floor had all his windows blown out. His kitchen cabinets were thrown outside taking down the kitchen wall. Above him a mother and a baby were stuck on a balcony. The mother had to throw her baby down to her neighborgh before others helped her get down the balcony. Another mother and her two kids were stuck on the seconf floor. The blast was so powerful that even the window guards flew off and the front door of one of the appartment units got stuck in the power lines across the street.  The building looked like it had been devastated by a tornado.

the overpass where the bus fell from8 passengers and a driver were injured in a MTA bus accident last week. The driver lost control of the bus and  plunged from an overpass, leaving the articulated bus dangling over an expressway in the Bronx.

The accident occurred as the articulated bus was on the University Avenue overpass above the Cross Bronx Express Way. According to preliminary investigation speed was a factor in the accident. As he made the turn to get on the  overpass, the driver’s speed was between 17 and 26 mph while the safe speed for such a large bus should have been 3 to 4 mph.  He lost control of the bus, teared through a metal gate and plunged 50 feet over the overpass, leaving the accordion bus dangling from the overpass with its nose on the expressway below. The bus driver was able to extricate himself from the bus and help other passengers to get out of the bus. he suffered jaw, leg and knee injury. 8 other passengers were injured including two seriously. They were all transported to the hospital.

protected bike lane saves livesWhile bicycle accidents injuries in New York City went down by 3.6% during the last 3 months compared to the same period last year, bicycle accident injuries in the Bronx increased by 35 %. Bicyclist activist organization, Transportation Alternatives has been asking the city to install more bike lanes in the Bronx but instead the DOT is planning to use more police enforcement.

At the beginning of the summer the NYPD organized a four-weeks enforcement blitz to tame down speeding and failure to yield at Bronx high crash corridors such as Bruckner Boulevard and is planning to organize another one soon.

However while the blitz was  effective in preventing pedestrian accidents, it didn’t curb the soaring number of bicycle accidents in the Bronx this summer. On June 11th, a 24 year old cyclist died from his injuries  after being hit by a car on on Willis Avenue and E. 138th Street. The same day, a 38 year old cyclist was fatally struck by a truck on Park Avenue near 138th Street. Then, on June 20, a 43 year old man riding a e-bike in Pelham Bay Park died after being struck by a vehicle. Last week a cyclist who was hit by a car near East 175th street on August 5th and fought for his life for almost a month, died from his injuries. As mentioned above the number of bicycle accidents injuries is also soaring in the Bronx and a police blitz will have little effect on changing this dangerous trend. In an article in StreetBlog, Edwin Figueroa, a senior organizer at Transportation Alternatives, is asking for permanent measures allowing cyclists to be safe when commuting in the Bronx. “What cyclists from all over the city, but especially in the Bronx, need from this administration is more protected bike-lane infrastructure. The Bronx needs redesigned streets that are self-enforcing, not streets that are reliant on NYPD enforcement to ensure safeness,” he said.

6 hard hats were injured on construction sites in New York City during the month of April compared to 47 a month earlier and 44 in April 2019. 4 workers were injured on Bronx construction sites and 2 of them on Brooklyn sites. 4 workers suffered minor injuries and 2 others who were injured by a plywood piece  on a windy day, required hospitalization. No fatalities were reported to the DOB during the month of April. The significant decline in construction accident injuries in the city is related to the Covid-19 restrictions that allowed only essential construction sites to be open during the month of April.

In one of the accidents a plumber accidentally screwed his own finger during a plumbing operation. He suffered a cut and was treated at an emergency room. He was then released in stable condition. While the DOB determined that the accident was caused by the worker’s error, inspectors found several safety violations at the construction site located on 1325 Jerome Avenue in the Bronx and issued several citations including: failure to maintain vertical netting, failure to maintain the site clean, failure to provide covers for holes on the floor, failure to protect an elevator shaft opening, failure to install a handrail system on stairways as well as failure to notify the DOB of a change of site safety manager. A partial stop work order was issued.

In an other accident, also in the Bronx, a worker suffered muscle cramps after another worker with whom he was carrying a PVC pipe suddenly put his end down.

location of the deadly car crashTwo people died and 6 people were injured in car crashes in New York City in less than 24h. As New York is reopening, the number of car accidents which had significantly declined during the lock down are expected to rise again.

The first car accident occurred on Sunday night around 11:20 pm in Pelham Bay Park in the Bronx. The 35 year old driver of a 2010 Toyota Camry lost control of his car as he was driving in the westbound lane of City Island Road near the intersection of Shore Road.  He rear ended the car in front of him, a 2014 Infiniti Q50 driven by a 27 year-old driver. The driver of the Infinity crashed into the rear of another car in front of him, a 2008 Toyota Highlander driven by a 51 year old man. The Camry careened into the eastbound line and hit a 2016 Jeep Grand Cherokee driven by a 44 year old man and a 2010 BMW X5 driven by a 41 year old man.

The driver of the Camry died at the scene of the accident. A 34 year old woman, who was sitting in the front seat next to him was rushed to the hospital in critical condition.  5 more people were taken to the hospital, they were occupants of the Infinity and the Jeep. The occupants of the BMW, which was the last car to be struck declined medical attention.

Bronx bicycle accidents second week of June 20202 people were killed and 20 of them were injured in bicycle accidents in the Bronx, NYC, during the second week of June. Bicycle accident injuries in the Bronx increased by 81.8 % during the week of June 8 to June 14 according to NYPD statistics.  The Bronx is the only NYC borough where bicycle accident injuries increased during this week. In all other NYC boroughs, bicycle accident injuries declined. On average, injuries related to bike crashes were down 30.7% citywide. The largest decline, 59.1%, was observed in the North part of Queens, followed by a decline of 50% of bicycle accident injuries in the South part of Brooklyn, a 45% decline in the North part of Brooklyn, a decrease of 33.3% in the South part of Manhattan, a decrease of  29.4% in the North part of Manhattan, a 16.7% decline in the South of Queens and  a status quo in Staten Island.

The Bronx is the borough that has the less investment by the city in infrastructures to protect bicyclists despite a large part of the population using bikes on a daily basis, including many delivery cyclists

While the city has been creating protected bike lanes all over rich white neighborhoods, the poor  area of the Bronx didn’t get any of these. Even last month when de Blasio announced more streets closed to traffic and a extra 9.2 miles of protected bike lanes, none of them were in the Bronx.

The accident took place on Saturday morning around 5:40 am. 27 year old Divante New was driving the car of 36 year old Sayquan Hallums who was in the passenger seat. They were driving the wrong way on the Grand Central Parkway near the Cross Island Parkway exit in Queens when they crashed into another car. 26 year old Megan Ann Smith who was in the passenger seat was killed. Her boyfriend who was driving the car was critically injured. The police didn’t release his identity. Megan Ann Smith graduated in 2011 from St. John’s Preparatory School in Astoria, Queens. She was an an honor student and a member of the softball team. Her family declined to talk to the media.

Foggy windshield might have play a role in the deadly accident

According to the brother of Sayquan, the Honda car driven by Divante had an old defective windshield that would fog up easily. He said that when the heat was up inside the car the old windshield would fog up so badly that only Sayquan was able to drive the car.

burn injuries suffered by Claudette in the botched chemistry experiment18 year old Claudette Joseph and another female student suffered severe burn injuries in a botched chemistry experiment that occurred in October 2018 at the Morris Academy for Collaborative Studies High School for Violin and Dance located in the Bronx, NYC. Our partner Jeffrey Bloom is representing Claudette and recently filed a lawsuit on her behalf.

Claudette was burned in an accident similar to the one suffered by Alonso Yanes, another client from our firm who was represented by Ben Rubionowitz ( read more about this personal injury case). She was part of a group of students attending a so-called “Carbon Snake Experiment”. The experiment consists in burning sugar and baking soda together. As the sugar and the baking soda burn and decompose, carbon dioxide gets trapped within the carbon and creates gas pockets that extend longer and longer like a black snake. Students were gathered around Eric Broussard, the teacher  to look at the experiment. Despite a recent CSB_Back_to_School_Safety_Alert  asking chemistry teachers to use only small quantities of flammable chemicals during experiments, the teacher used a bottle of rubbing alcohol for the experiment. Vapors came out of the opened bottle and ignited in a fireball that severely burned Claudette and another student on their face, torso and hands.

Both students were rushed to the hospital to be treated. Claudette suffered second degrees burns that have left her with permanent scars. The young woman who is an accomplished violonist  is still traumatized by the horrific accident. “This has been extremely traumatic for her and her family,” Jeffrey Bloom told The Post. “Every time she sees these scars, she is reminded of what happened that day.”

A hard hat died and five others were injured after a building under construction partially collapsed in the Bronx. 48 year old Segundo Huerta, a father of five, was working on a construction site located at 92 East 208 Street in the Bronx, on Monday around noon, when the third floor of the building started to crumble and falling on workers below. Segundo and his colleagues were hit and buried in concrete and debris.  When  the firefighters arrived, Segundo was trapped and by the time they were able to recover him he had succumbed to fatal injuries.

The other construction workers injured  were Segundo’s family members or good friends. His 21 year old nephew Manuel Giovanni Huerta suffered a serious spine injury. His cousin Santiago Mayancela suffered a torn ear and a leg injury. Luis Romero, the brother of Segundo’s sister in law suffered a serious head injury. Two friends from the family Luis Antonmio Quizhpi and a man identified as Jose were also injured. The group of workers had been working together on construction  sites for more than 12 years. Segundo, originally from Ecuator, had been living in the US for 19 years. The family and relatives that gathered at the scene of the accident were heart broken.
