Day Care Owner Sentenced to 45 Years for Fentanyl Death of 1-Year-Old

Investigators determined that kitchen utensils used to prepare meals for the children were also used to package narcotics, raising concerns that the children’s lunch may have been the source of exposure.

Mendez’s husband, Felix Herrera Garcia, who fled the scene while Nicholas lay dying, was sentenced to 45 years in prison last October. Surveillance footage captured him rushing into the building before escaping through an alley, carrying heavy bags believed to contain narcotics.

Gross Negligence and Destruction of Evidence

Rather than immediately calling for medical help, Mendez called Herrera Garcia first. She then deleted over 20,000 WhatsApp messages, some of which discussed drug transactions using coded language. These messages, later recovered by authorities, directly contradicted her claims of ignorance. Judge Jed S. Rakoff, who presided over the case, condemned Mendez’s actions, stating that she put her own fear of getting caught above the opportunity to save a child’s life.
