37,461 people died in car accidents in the US last year according to data released last week by the US Department of Transportation’s National Traffic Safety Administration. This number is the highest since 2007. Traffic fatalities rose 5.6% compared to 2015. This increase follows another 8.4% rise from 2014 to 2015.  Speeding, drunk driving and the lack of seat belts were the most common factors in the deadly accidents. Car accident deaths related to distracted driving and drowsy driving recorded a decline.

Since Vision Zero started in 2014 fewer people are dying in traffic accidents in New York City but more and more are getting injured. Vision Zero initiatives  helped decrease the number of pedestrian deaths and injuries however the number of motorists injured in car accidents in the city increased at an alarming rate over the last 3 years.

5,163 people suffered personal injury in motor vehicle accidents in New York City last August compared to respectively 5,383,  4,737, 4,445, 4,007 and 4,846 in August 2016, 2015, 2014 and 2013.  Since the month of May the monthly number of people injured in traffic accidents stayed above 5,000.  The same occurred last summer as well.

Despite a decrease in both pedestrian and bicycle accident injuries over the last 3 years the total number of motor vehicle accident injuries continued to grow mostly due to a steady increase of motorist injuries over the last 3 years.

Morgan Wang suffered Spinal Injury in a NY Car AccidentBen Rubinowitz, managing partner at Gair, Gair, Conason, Rubinowitz, Bloom, Hershenhorn, Steigman & Mackauf just obtained one of the largest verdicts ever in the Country for a Spinal Injury case. The Plaintiff, Morgan Wang, was awarded $71 Million by a Manhattan Jury last Thursday.

The case was tried before Supreme Court Judge James d’Auguste. After 3 weeks of trial, the Manhattan Jury awarded Ms. Wang a stunning amount of money to fully and fairly compensate her for injuries suffered in a car accident in New York in August of 2012. The jury awarded $5 million for her Past Pain and Suffering, 6 Million for her Future Pain and Suffering and 60 Million for her medical needs over her lifetime. “We put in an incredible amount of time and effort to make sure Morgan received Justice” said Ben Rubinowitz, who represented Morgan at trial, noting that “this young girl suffered life changing injuries.” She came to the right law firm. “We have a tremendous amount of expertise with Spinal Cord Injuries and no one will work harder or prepare for trialthe car after the accident better than us” said Rubinowitz.

The jury of 3 men and 3 women took two days to reach their verdict. Morgan suffered a fracture of her Lumbar Spine, often referred to as a broken back. Although she is now able to walk with braces, she still suffers from Neurogenic Bowel, a condition that makes it difficult for her to move her bowels.  As a result she will need continued medical and psychiatric care for the rest of her life. “Morgan is an amazing young woman” said Rubinowitz. “She refused to listen to her doctors at the trauma center who said she would never walk again. She overcame tremendous obstacles and worked through her pain at Mt Sinai Rehabilitation Center in Manhattan to learn to walk again. She is the epitome of someone who will never give up. I am proud of Morgan. She cares deeply about people and, to show you how remarkable she is, she now donates her time to help injured veterans. It was an honor to represent Morgan.”

accident sceneA pedestrian in a wheelchair was seriously injured after being hit by a cab in New York. The elderly man whose identity wasn’t revealed was in a motorized wheelchair on Park Ave near 86th street when the taxi struck him. The accident occurred yesterday afternoon around 2 pm. The cab driver stayed at the scene of the accident. The NY Daily News indicates that he was taken into custody for a charge not related to the accident.

Over the summer several accidents involving yellow cabs occurred on the Upper East Side. On September 14th a woman died after being hit by two consecutive yellow cabs on Lexington between 68th and 69th street (see previous blog). In August, a family who was brunching at the corner of 85th and Second Ave was almost killed after two cabs collided (see previous blog).  In July, 80 year old Barbara Horn was killed by a yellow taxi while she was in the crosswalk. The taxi was making a left turn from third Ave onto 70th street (see previous blog).

truck and bicycle accident locationA cyclist was fatally hit by a truck in New York  and another one was critically injured after being struck by a car yesterday in Brooklyn. The first accident occurred in  Crown Heights, Brooklyn, around 7:00 am. A  35 year old man was riding his bike on Utica Avenue when he got hit by a car at the intersection of Empire Boulevard. The cyclist suffered critical injury and was rushed to a nearby hospital. The driver stayed at the scene of the accident and wasn’t charged. (read more on PIX11).

Another bicycle accident occurred later on around 5:45 pm in Manhattan. A box truck  fatally hit a cyclist. The 38 year old truck driver was driving East on Walker Street. As he was making a right turn onto Broadway he hit 48 year old Yan Jindee who was riding her bike.  A witness working near the scene of the accident said he heard a loud bang and stepped out. He saw the victim on the ground. When the paramedics arrived the victim was unconscious. They performed CPR on her for a few minutes but they couldn’t save her. The driver stayed at the scene of the accident. According to the police, it is not clear yet if he is facing charges or not. There are no bike lanes  either on Walker or on Broadway. (read more in the NY Daily  News)

A New York City cab driver whose passenger fell out of his cab just continued on his way. Seconds later the passenger was hit by another yellow cab who also fled the scene of the accident and left her dead on the road. The hit and run accident occurred as the taxi was heading South on Lexington Ave between 69th and 68th  Streets yesterday morning a little after 5:00 am. For some unknown reason  the woman who was riding the taxi opened the rear door and fell out of it. Moment later another yellow cab also driving South on Lexington hit her and never stopped. The victim was rushed to the hospital but she couldn’t be saved. The police weren’t able to identify her but according to witnesses she was a homeless person often seen in the area.  The police were able to find the first cab driver. He was identified as 46 year old Azizur Mazumder and was arrested by the police two hours later near the accident scene. He was charged with reckless endangerment and leaving the scene of a fatal accident. The police are still looking for the second hit and run cab driver. Read more in the NY Daily News

accident sceneA sedan crashed into a police cruiser yesterday night in Brooklyn at the corner of Ralph Ave and Macdonough St. in Bedford-Stuyvesant. The car accident occurred as the driver of the sedan was trying to escape the police.

Yesterday night  19 year old Scott Adam was behind the wheel of a black Sedan. His passenger was 29-year old Marquise Middeltown. After he blew a red light, two police officers approached the car to ask him to pull over. Instead Adam tried to escape but the young driver lost control of his vehicle. He almost hit the two officers and crashed into their cruiser. He was charged Today with reckless endangerment, assault with a vehicle, fleeing police and running a red light. Adam has two prior arrests. His passenger who was critically injured in the accident was charged with illegal weapons possession and reckless endangerment. He has 22 prior arrests.

6 people were injured including 3 seriously in a car accident in Staten Island, NYC on Sunday. A 74 year old driver who was backing out of a parking spot in front of a laundromat, hit the gas instead of the brake and reared back at full speed in the busy laundromat. The storefront was completely destroyed and damages are estimated to be above $20,000. 8 customers were inside the laundromat at the time of the accident. 6 of them were hurt including a pregnant woman who complained she couldn’t feel her legs anymore. She was in a lot of pain according to witnesses. Some of the customers were directly hit by the car and others by the folding tables that came crashing against the washing machines and dryers. The accident was extremely scary.  According to the owner of the laundromat it is not the first time that a car crashed into the storefront. A FDNY truck crashed into two cars in New York City on Saturday injuring 7 people including a child.  The accident occurred in Queens at the intersection of Booth Memorial Ave and Kissena Blvd. The fire truck was on its way to a fire in Flushing and its sirens were on.  The fire truck hit a Lexus SUV. The Lexus SUV then ricocheted into a Mercedes SUV.  The Mercedes flipped over on its side. A total of 10 people were injured in the firetruck crash. 7 of them were transported to the hospital with serious injuries. Among them a child and an adult were critically injured. 3 other people including a firefighter were treated for minor injuries at the scene of the accident.

According to a study, there are around 30,000 firetruck crashes every year in the U.S. Firetruck crashes are also the second leading cause of death of on-duty firefighters. In New York City alone, there are between 20 and 40 crashes every month.
