Our Partner Christopher J. Donadio has been invited to provide a plaintiff’s attorneys perspective on the current trends in shoulder dystocia cases. Shoulder dystocia is the medical terminology for when during the delivery of a newborn, the newborn’s shoulder gets stuck on the mother’s pubic bone. This is a medical emergency, as severe injury or brain damage can result if the shoulder dystocia is not timely remedied. Unfortunately, when obstetricians do not use the appropriate techniques to resolve a shoulder dystocia, injury to the brachial plexus nerve can occur. This results in what is called an “Erb’s Palsy.” A child with an Erb’s Palsy will have a deformity of the arm, and an inability to fully utilize their arm.
Mr. Donadio will be lecturing as to the issues that plaintiff’s attorney must consider in litigating shoulder dystocia cases, including how to handle the common defenses raised by defendant obstetricians.
